Terms of Service
1. AGREEMENT TO TERMS
Welcome to Mane-Tained. These Terms of Use ("Terms") govern your access to and use of www.mane-tained.com (the "Site"), our online booking system, our text and email communications, and any services or products you purchase from Mane-Tained Salon & Extensions ("Mane-Tained," "we," "us," or "our").
By accessing the Site, booking an appointment, purchasing a product, or otherwise engaging with us, you agree to these Terms. If you do not agree, please do not use the Site or our services.
We operate studios at 763 Baker Street, Costa Mesa, California, and at 26731 Aliso Creek Road, suite 200, Aliso Viejo, California.
2. ELIGIBILITY
You must be at least 18 years of age to book appointments, make purchases, or create an account on this Site. Guests under 18 may receive services only with the consent and presence of a parent or legal guardian, who assumes full responsibility for the appointment and any associated charges.
3. OUR SERVICES
Mane-Tained provides hair services (including cutting, color, styling, and hand-tied extensions), esthetic services, lash services, and retail products. Services are performed by licensed professionals in accordance with the requirements of the California Board of Barbering and Cosmetology.
Service descriptions, images, and pricing on the Site are provided for general reference. Final pricing is determined during consultation and may vary based on hair length, density, condition, product volume, and time required. We will always confirm pricing with you before beginning any service.
Pricing is based on the service performed, the time required, and the products used. Pricing is never based on gender, consistent with California Civil Code Section 51.6.
4. APPOINTMENTS, DEPOSITS, AND CANCELLATIONS
Booking. Appointments may be requested through the Site, by phone, or in studio. An appointment is confirmed only when you receive confirmation from us.
Card on File. We require a valid credit or debit card to reserve an appointment. Your card will not be charged at the time of booking except where a deposit is required.
Deposits. Certain services, including extension installations and multi-hour color appointments, require a non-refundable deposit of $100. Deposits are applied toward the final service total.
Cancellation Policy. We ask for at least 48 hours' notice to cancel or reschedule. Cancellations made with less than 24 hours' notice may be charged 50% of the scheduled service total. No-shows may be charged 100% of the scheduled service total.
Late Arrivals. If you arrive more than 15 minutes past your appointment time, we may need to modify or reschedule your service to protect the guests booked after you.
By booking, you authorize us to charge the card on file for any applicable cancellation, no-show, or service fees.
5. PAYMENT
We accept cash, credit cards, zelle, venmo. Payment is due in full at the time services are rendered or products are purchased. All prices are in U.S. dollars and exclusive of applicable sales tax.
You represent that you are authorized to use any payment method you provide and that the information you provide is accurate and complete.
6. SERVICE ADJUSTMENTS AND RETURNS
Services. Because hair services are performed and cannot be returned, all service sales are final. If you are not satisfied with your service, contact us within 7 days and we will schedule a complimentary adjustment with your stylist. Adjustments are limited to the service originally performed and do not include a change of desired result discussed and agreed upon at consultation.
Retail Products. Unopened retail products in original condition may be returned within 14 days of purchase for exchange or store credit. Opened products may be exchanged at our discretion if there is a performance or reaction concern.
Extension Hair and Mane + Stitch Products. Due to sanitation requirements, all extension hair and Mane + Stitch inventory sales are final once the packaging is opened. Unopened, unaltered hair may be returned within 14 days subject to a 10% restocking fee. Wholesale purchases by licensed professionals are governed by our separate wholesale terms.
7. GIFT CARDS
Gift cards purchased from Mane-Tained do not expire and carry no dormancy or service fees, consistent with California Civil Code Sections 1749.45 through 1749.6. Gift cards are redeemable for services and retail products, are not redeemable for cash except as required by California law (cash back is available for balances under ten dollars), and are not replaceable if lost or stolen.
8. MEMBERSHIPS AND RECURRING PROGRAMS
If you enroll in any membership, package, or recurring billing program, we will disclose the full terms, the recurring charge amount, and the billing frequency before you enroll, and we will obtain your affirmative consent. You may cancel at any time by emailing hello@mane-tained.com or cancel manually through the Vagaro app/website. A 14 day notice is required. No credits for services will roll over if not used by the end of the billing period. These programs are offered in accordance with California's Automatic Renewal Law, Business and Professions Code Section 17600 and following.
9. HEALTH, ALLERGIES, AND ASSUMPTION OF RISK
You are responsible for disclosing to your stylist or provider, before service begins, any of the following:
Known allergies or sensitivities to hair color, chemicals, adhesives, latex, or skincare ingredients
Scalp or skin conditions
Recent chemical services performed elsewhere, including box color, henna, keratin treatments, or relaxers
Medications, medical conditions, or treatments that may affect hair or skin, including pregnancy
Prior adverse reactions to any salon service
Chemical and color services carry inherent risks, including allergic reaction, scalp irritation, breakage, and unpredictable results, particularly when prior chemical services or at-home color have been performed. Patch testing is available upon request and is recommended for any guest with a history of sensitivity.
Extension services place tension on natural hair. Proper home care and adherence to your recommended maintenance schedule are required. Damage resulting from missed maintenance appointments, improper home care, or removal by anyone other than a qualified professional is not the responsibility of Mane-Tained.
Results vary from guest to guest. Photographs, portfolio images, and reference images do not constitute a guarantee of outcome.
10. PHOTOGRAPHY AND GUEST CONTENT
Our Photography. We may photograph or record your hair and services for portfolio, educational, and marketing purposes. We will ask for your consent before doing so, and you may decline at any time without any effect on your service. If you consent, you grant Mane-Tained a non-exclusive, royalty-free, perpetual license to use those images across our website, social media, print materials, and promotional content.
Your Content. If you post reviews, comments, photos, or other content to our Site or tag us on social media, you grant us a non-exclusive, royalty-free license to reproduce and share that content in connection with our business, with attribution where appropriate. You represent that you own or have permission to share anything you submit and that it does not violate the rights of any third party.
We reserve the right to remove any content that is unlawful, defamatory, harassing, or otherwise inappropriate.
11. INTELLECTUAL PROPERTY
All content on the Site, including the Mane-Tained and Mane + Stitch names and logos, text, graphics, photographs, video, service names, and program names, is the property of Mane-Tained or its licensors and is protected by United States copyright and trademark law.
You may view and print Site content for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any Site content without our prior written permission.
12. COMMUNICATIONS AND TEXT MESSAGING
By providing your phone number, you consent to receive appointment confirmations, reminders, and service-related messages from Mane-Tained by text and phone. Marketing messages are sent only with your separate consent. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and you may opt out of marketing emails using the unsubscribe link in any email. Opting out of marketing messages does not opt you out of transactional appointment messages.
13. PRIVACY
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share your information, and which explains your rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act. The Privacy Policy is incorporated into these Terms by reference.
14. PROHIBITED CONDUCT
You agree not to use the Site to:
Violate any applicable law or regulation
Impersonate any person or misrepresent your affiliation with any person or entity
Submit false or fraudulent bookings, payment information, or reviews
Introduce viruses, malware, or any other harmful code
Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
Scrape, harvest, or collect information about other users
Interfere with the proper functioning of the Site
We reserve the right to refuse service, cancel appointments, and restrict access to the Site at our discretion, consistent with applicable law.
15. THIRD-PARTY LINKS AND SERVICES
The Site may link to or integrate third-party services, including our booking platform, payment processors, and social media platforms. We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of a third-party service is governed by that party's own terms and privacy policy.
16. DISCLAIMER OF WARRANTIES
The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Mane-Tained disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is complete, accurate, or current. Information on the Site regarding hair care, products, or services is general in nature and is not a substitute for professional medical or dermatological advice.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by California law, Mane-Tained and its owners, employees, independent contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, our services, or our products.
Our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or any service or product will not exceed the amount you paid to Mane-Tained for the service or product giving rise to the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under California law, including liability for gross negligence, willful misconduct, or fraud.
18. INDEMNIFICATION
You agree to indemnify and hold harmless Mane-Tained and its owners, employees, and independent contractors from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.
19. DISPUTE RESOLUTION
Informal Resolution First. If you have a concern, please contact us at hello@mane-tained.com so we can try to resolve it directly. Most matters are resolved this way.
Governing Law. These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
Venue. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
20. ACCESSIBILITY
Mane-Tained is committed to making our studios and our website accessible to all guests. If you encounter difficulty accessing any part of the Site, or if you need an accommodation for your appointment, please contact us at hello@mane-tained.com or 949-680-0170 and we will work with you to provide the information or service you need.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be posted on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
22. GENERAL PROVISIONS
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any provision does not waive our right to enforce it later.
Entire Agreement. These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Mane-Tained regarding your use of the Site.
Assignment. You may not assign these Terms. We may assign them in connection with a sale, merger, or reorganization of our business.
